【摘要】：隨著時(shí)代的發(fā)展,我國(guó)生態(tài)文明取得了一定的進(jìn)步,各項(xiàng)生態(tài)文明法律保障體系也在逐漸完善。目前我國(guó)《海島保護(hù)法》確立了"保護(hù)優(yōu)先"原則,然而"保護(hù)優(yōu)先"原則并不能良好解決生態(tài)保護(hù)與經(jīng)濟(jì)發(fā)展關(guān)系的完整原則,因此需要發(fā)揚(yáng)生態(tài)保護(hù)優(yōu)先觀,以生態(tài)系統(tǒng)作為規(guī)范人們行為和經(jīng)濟(jì)發(fā)展的約束條件,實(shí)現(xiàn)人與自然的和諧發(fā)展。本文主要分析了無(wú)居民海島立法的生態(tài)保護(hù)優(yōu)先原則,并針對(duì)生態(tài)保護(hù)優(yōu)先下海島保護(hù)法基本制度構(gòu)建進(jìn)行了研究和探討。
[Abstract]:With the development of ecological civilization in China has made some progress, the ecological civilization of legal system is gradually perfected. The island protection law of our country < > to establish a "conservation priority" principle, but the "protection first" principle and can not solve the relationship between ecological protection and economic development of the whole principle, so we need to carry forward the concept of ecological protection priority, ecological system as constraints to regulate people's behavior and economic development, realize the harmonious development of man and nature. This paper mainly analyzes the principle of giving priority to ecological protection of uninhabited islands legislation, and according to the ecological conservation priority under the island protection law of the basic construction of the system are studied and discussed.
