【摘要】： 飲用水是人類生存的基本需求,飲用水是否安全直接關(guān)系到廣大人民群眾的健康。但是,我國飲用水卻存在著“不安全”的態(tài)勢(shì),不少地區(qū)水資源短缺,有的城市飲用水水源污染加重,一些農(nóng)村地區(qū)飲用水存在苦咸或含有高氟、高砷及血吸蟲病原體等問題,對(duì)人民群眾身體健康構(gòu)成嚴(yán)重威脅。這些嚴(yán)重的安全隱患已成為突出的環(huán)境問題及社會(huì)問題。 文章以比較法學(xué)為視角,研究和比較了中美兩國飲用水安全的法律保障問題,以期為更好地解決我國飲用水安全法律保障的理論和實(shí)踐中存在的問題提供一些借鑒。 文章采取比較分析、實(shí)證分析、規(guī)范分析和歷史分析等方法,以提出問題、分析問題、解決問題為思路,嘗試著對(duì)中美飲用水安全法律保障問題作一番初淺的探討。文章首先對(duì)飲用水安全法律保障所涉及的相關(guān)問題進(jìn)行初步闡述,明確了飲用水安全的含義,論述了保障飲用水安全的重要性和可行性;接著對(duì)中美兩國飲用水安全法律保障的法律體系進(jìn)行了比較研究,通過比較找出了我國飲用水安全法律保障的法律體系結(jié)構(gòu)中存在的立法空白及不足;接下來對(duì)中美飲用水安全法律保障的相關(guān)內(nèi)容進(jìn)行了比較,其中重點(diǎn)比較了管理體制、基本制度、法律責(zé)任三個(gè)方面,并在此基礎(chǔ)上,找出了我國飲用水安全法律保障內(nèi)容上存在的問題;最后,針對(duì)我國相關(guān)法律體系及相關(guān)內(nèi)容中存在的問題提出了對(duì)我國飲用水安全法律保障相關(guān)問題的完善建議。建議在確立飲用水安全法律保障的指導(dǎo)思想和基本原則的前提下,完善我國飲用水安全法律保障的法律體系、管理體制和基本制度。
[Abstract]:Drinking water is the basic requirement of human survival. The safety of drinking water is directly related to the health of the people. However, there is an "unsafe" situation in drinking water in China, and water resources are in short supply in many areas. In some cities, the pollution of drinking water sources has increased. In some rural areas, drinking water has some problems, such as brackish or high fluoride, arsenic and schistosomiasis pathogens. These serious safety risks have become prominent environmental and social problems. From the perspective of comparative jurisprudence, this paper studies and compares the legal protection of drinking water safety between China and the United States in order to provide some references for solving the problems existing in the theory and practice of the legal protection of drinking water safety in China. This paper adopts the methods of comparative analysis, empirical analysis, normative analysis and historical analysis. This paper attempts to make a preliminary discussion on the legal protection of drinking water safety in China and the United States. Firstly, the article makes a preliminary exposition on the relevant issues involved in the legal protection of drinking water safety, and clarifies the meaning of drinking water safety. This paper discusses the importance and feasibility of ensuring the safety of drinking water, and then makes a comparative study on the legal system of the legal protection of drinking water safety between China and the United States. Through the comparison to find out the legislative gaps and deficiencies in the legal system of drinking water safety in our country. Then, compared the relevant contents of the legal protection of drinking water safety between China and the United States, among which the emphasis is on the comparison of the management system. Basic system, legal liability, and on this basis, found out our drinking water safety in the content of legal protection problems; finally, In view of the problems existing in the relevant legal system and related contents of our country, this paper puts forward some suggestions for the improvement of the relevant problems in the legal protection of drinking water safety in our country. Under the premise of establishing the guiding ideology and basic principles of the legal protection of drinking water safety, the author suggests that, Improve our drinking water safety legal system, management system and basic system.
