【摘要】: 隨著社會(huì)的進(jìn)步,交通工具的大型化與復(fù)雜化,增加了第三人人身傷亡及財(cái)產(chǎn)損失等問題發(fā)生的可能性及傷亡和損失的程度。在海事領(lǐng)域,船舶一旦發(fā)生漏油、傾覆等海上事故會(huì)對(duì)沿海國(guó)及船東本身造成巨大的經(jīng)濟(jì)損失,而船東面臨的索賠即便是船東傾家蕩產(chǎn)也往往不足以彌補(bǔ)事故地區(qū)所受到的損失。這種情形顯然既不利于海上航運(yùn)業(yè)的發(fā)展也不利于受到損害地區(qū)經(jīng)濟(jì)及環(huán)境的恢復(fù)與發(fā)展。在這種背景下,船舶強(qiáng)制責(zé)任保險(xiǎn)制度應(yīng)運(yùn)而生。以《1969年油污損害民事責(zé)任公約》為代表的相關(guān)海事公約所建立的船舶強(qiáng)制責(zé)任保險(xiǎn)制度取得了顯著成效,在很大程度上加強(qiáng)了船東進(jìn)行強(qiáng)制性責(zé)任保險(xiǎn)的意識(shí)和義務(wù),對(duì)航運(yùn)業(yè)的發(fā)展和事故地區(qū)經(jīng)濟(jì)及環(huán)境的恢復(fù)起到了相當(dāng)大的積極作用。 海事領(lǐng)域,國(guó)際海上保險(xiǎn)立法中強(qiáng)制責(zé)任保險(xiǎn)有強(qiáng)化的趨勢(shì);而我國(guó)《防治船舶污染海洋環(huán)境管理?xiàng)l例》也在2010年3月生效,該條例對(duì)我國(guó)船舶強(qiáng)制責(zé)任保險(xiǎn)制度的構(gòu)建具有里程碑式的意義。因此,在這樣的背景下,有必要對(duì)船舶強(qiáng)制責(zé)任保險(xiǎn)制度的相關(guān)問題進(jìn)行新的梳理。而本文的撰寫目的也意在于此,并對(duì)我國(guó)船舶強(qiáng)制責(zé)任保險(xiǎn)制度的構(gòu)建提出相應(yīng)的建議。 文章第一、二章論述了責(zé)任保險(xiǎn)和船舶強(qiáng)制責(zé)任保險(xiǎn)的相關(guān)理論基礎(chǔ),揭示了責(zé)任保險(xiǎn)產(chǎn)生的現(xiàn)實(shí)和理論基礎(chǔ),強(qiáng)制責(zé)任保險(xiǎn)的特點(diǎn),船舶強(qiáng)制責(zé)任保險(xiǎn)制度產(chǎn)生的法理基礎(chǔ)、性質(zhì)、意義與作用等等。 第三章深入研究了船舶強(qiáng)制責(zé)任保險(xiǎn)制度的基本內(nèi)容,包括該制度與相關(guān)其他制度的關(guān)系,法律關(guān)系主體,制度適用的范圍與船舶,第三人的直接請(qǐng)求權(quán),責(zé)任保險(xiǎn)人的抗辯權(quán),責(zé)任保險(xiǎn)人訴訟地位及責(zé)任保險(xiǎn)訴訟時(shí)效的起算標(biāo)準(zhǔn)。 第四章細(xì)致剖析了我國(guó)船舶強(qiáng)制責(zé)任保險(xiǎn)制度建設(shè)的現(xiàn)狀,從污染領(lǐng)域、客船旅客運(yùn)輸領(lǐng)域、殘骸清除打撈領(lǐng)域三個(gè)方面深入分析了在各領(lǐng)域建立船舶強(qiáng)制責(zé)任保險(xiǎn)制度的必要性以及我國(guó)相關(guān)法制建設(shè)過程中存在的問題。 第五章在上文研究、分析的基礎(chǔ)上,立足我國(guó)法律實(shí)際,進(jìn)一步檢討了我國(guó)相關(guān)法律、法規(guī)中存在的問題,進(jìn)而提出相關(guān)的立法建議。

Therefore, in this context, it is necessary to make a new combing the relevant problems of compulsory liability insurance system on the ship. And the purpose of writing this article is intended here, put forward and construction of compulsory liability insurance system of our country shipping advice accordingly.
The first, second chapter discusses the theoretical basis of liability insurance and marine compulsory liability insurance, liability insurance reveals the practical and theoretical foundation, the characteristics of compulsory liability insurance, legal basis, the compulsory liability insurance system from nature, significance and effect and so on.
The basic contents of the third chapter of the vessel compulsory insurance system, including the relationship between the system and other related system, legal relation subject, scope and ship system applicable to the direct claim of third party liability, the insurer's right of defense, the standard liability insurance legal status and liability insurance litigation.
The fourth chapter detailed analysis of the status quo of China's compulsory liability insurance system of ship construction, pollution from the field, the field of passenger transport of passenger ships, salvage wreck removal three areas in-depth analysis of the necessity of setting up the vessel compulsory insurance system in various fields and the related law system of our country in the process of construction.
The fifth chapter, based on the above research and analysis, based on the reality of China's law, further reviewed the problems existing in our relevant laws and regulations, and then put forward relevant legislative proposals.
