【摘要】：近年來,國際恐怖主義已經(jīng)成為國際社會(huì)和平與安全的重要威脅,打擊恐怖主義,保護(hù)國家和地區(qū)的穩(wěn)定已經(jīng)成為全世界的共同議題。自從上個(gè)世紀(jì)90年代以來,恐怖主義的猖獗行為已經(jīng)制造了多起大規(guī)模的恐怖事件,愈演愈烈的局勢使得任何國家在恐怖主義威脅下都不能幸免于難。震驚世人的2001年9·11事件使恐怖主義真正進(jìn)入人們視線,引起人們廣泛關(guān)注。恐怖主義集團(tuán)向世界人們展示了它們破壞世界的威力,也促使世界各國認(rèn)真反思如何行使自衛(wèi)權(quán)進(jìn)行反恐怖主義斗爭。自衛(wèi)權(quán)是國家擁有的可以行使武力的權(quán)利,在美國以行使“先發(fā)制人”的自衛(wèi)權(quán)為借口發(fā)動(dòng)阿富汗戰(zhàn)爭和伊拉克戰(zhàn)爭后,關(guān)于自衛(wèi)權(quán)的應(yīng)用問題引起了國際間的討論。自衛(wèi)權(quán)能否應(yīng)用于打擊恐怖主義、自衛(wèi)權(quán)法律內(nèi)容的不明確化以及自衛(wèi)權(quán)的濫用問題都阻礙了國際反恐怖主義的發(fā)展。本文將從自衛(wèi)權(quán)的法律內(nèi)容開始,分析自衛(wèi)權(quán)的發(fā)展現(xiàn)狀,結(jié)合國際間恐怖主義發(fā)展的新特點(diǎn),探討自衛(wèi)權(quán)在國際恐怖主義威脅下行使的可能性、合法性及其挑戰(zhàn),進(jìn)而通過分析各國在應(yīng)對恐怖主義威脅下采取的措施,為我國應(yīng)對恐怖主義威脅和維護(hù)世界和平與安全提供一些建議。
[Abstract]:In recent years, international terrorism has become an important threat to the peace and security of the international community. The fight against terrorism and the protection of national and regional stability have become a common issue all over the world. Since -10s, The rampant acts of terrorism have created a number of large-scale terrorist incidents. The growing situation has made it impossible for any country to survive under the threat of terrorism. The 9 / 11 incident of 2001, which shocked the world, really brought terrorism to the fore. There is widespread concern. Terrorist groups have shown the world how powerful they are to destroy the world. It also prompted countries around the world to seriously reflect on how to exercise their right to self-defence in the fight against terrorism. The right to self-defence is a right owned by States to exercise force, After the United States launched the war in Afghanistan and Iraq under the pretext of exercising its "pre-emptive" right of self-defence, the application of the right to self-defence has aroused international discussion. The lack of clarity of the legal content of the right of self-defence and the abuse of the right of self-defence hinder the development of international counter-terrorism. This paper will begin with the legal content of the right of self-defence and analyze the present situation of the development of the right of self-defence. Considering the new characteristics of the development of international terrorism, to explore the possibility, legitimacy and challenges of the exercise of the right to self-defence under the threat of international terrorism, and further by analysing the measures taken by States to deal with the threat of terrorism, To provide some suggestions for our country to deal with terrorist threats and to maintain world peace and security.
