【摘要】：在人類社會(huì)中,繼承是歷久彌新,關(guān)乎個(gè)人利益的重大課題。在不同歷史時(shí)期有著不同的內(nèi)涵。在當(dāng)今社會(huì),繼承通常指的是財(cái)產(chǎn)繼承。財(cái)產(chǎn)繼承制度對(duì)于維護(hù)社會(huì)的經(jīng)濟(jì)制度,促進(jìn)家庭的和諧穩(wěn)定,進(jìn)而構(gòu)建社會(huì)主義和諧社會(huì)都起著非常重要的作用。我國從國情出發(fā),制定了1985年《中華人民共和國繼承法》,確立了具有中國特色的法定繼承制度。繼承權(quán)公證是國家公證機(jī)構(gòu)根據(jù)當(dāng)事人的申請(qǐng),依照法律規(guī)定證明哪些人對(duì)被繼承人的遺產(chǎn)享有繼承權(quán)并證明其繼承活動(dòng)真實(shí)、合法。繼承權(quán)公證根據(jù)被繼承人生前有無遺囑分為依遺囑繼承、依法定順序繼承。繼承公證能夠有效確定繼承關(guān)系,保護(hù)繼承人的合法權(quán)益,是繼承法律制度重要組成部分。 本文將從繼承公證法律制度的基本概況入手,對(duì)繼承公證法律制度存在的問題和原因進(jìn)行分析,進(jìn)而對(duì)完善我國繼承公證法律制度進(jìn)行深層次說明,以期為完善我國的公證制度,使我國公民的順利行使繼承權(quán)利盡微薄之力。
[Abstract]:In human society, inheritance is a new and important issue related to personal interests. It has different connotations in different historical periods. In today's society, inheritance usually refers to inheritance of property. The property inheritance system plays a very important role in maintaining the social economic system, promoting the harmony and stability of the family, and then constructing the socialist harmonious society. Based on the national conditions, China formulated the Law of succession of the people's Republic of China in 1985 and established the legal succession system with Chinese characteristics. Notarization of inheritance right is that according to the application of the parties, the notarization institution of the state certifies who have the inheritance right to the inheritance of the heir and the truth and legality of their inheritance activities in accordance with the provisions of the law. The notarization of inheritance rights is divided into succession according to will and legal order according to the intestate of the heir. Inheritance notarization can effectively determine the inheritance relationship and protect the legal rights and interests of heirs. It is an important part of the inheritance legal system. Starting with the basic situation of inheriting notarization legal system, this paper analyzes the existing problems and causes of inheriting notarization legal system, and then makes a deep explanation for perfecting the legal system of inheriting notarization in our country. In order to perfect the notarization system of our country, make our country citizen to carry out the inheritance right smoothly to make meagre efforts.
