【摘要】： 近年來,南非的國際貿(mào)易在南非經(jīng)濟的現(xiàn)代化進程中充當(dāng)著越來越重要的角色。2002年,南非制定了專門規(guī)范南非進出口貿(mào)易市場和促進國際貿(mào)易發(fā)展的法律--南非《國際貿(mào)易管理法》,成立了國際貿(mào)易管理委員會,全面負(fù)責(zé)處理南非貿(mào)易進出口過程中出現(xiàn)的狀況。隨著中國和南非關(guān)系的進一步發(fā)展,中國與南非之間的貿(mào)易越來越頻繁,對南非國際貿(mào)易管理委員會的研究也日益重要,但是由于這一執(zhí)法機構(gòu)成立的時間尚短,目前國內(nèi)研究這一極具特色的國際貿(mào)易管理機構(gòu)的成果基本屬于空白,因此,對南非國際貿(mào)易管理法律體系的研究有著現(xiàn)實的意義。 南非《國際貿(mào)易管理法》的制訂和南非國際貿(mào)易管理委員會的成立,為南非這個新興貿(mào)易市場提供了更加強有力的制度保障和機構(gòu)支持。國際貿(mào)易管理委員會既負(fù)責(zé)調(diào)查發(fā)生在關(guān)稅同盟境內(nèi)對進口產(chǎn)品的反傾銷、反補貼和保障措施以及有關(guān)復(fù)審工作,同時也負(fù)責(zé)調(diào)查關(guān)稅同盟外南非的有關(guān)進出口事項,并有權(quán)要求當(dāng)?shù)剡M出口商提供其商業(yè)活動的信息,被調(diào)查的進出口商應(yīng)當(dāng)盡誠信義務(wù),為管理委員會提供所需信息,如果違反該法的有關(guān)規(guī)定,則有可能受到不同程度的處罰。反之,國際貿(mào)易管理委員會也應(yīng)當(dāng)充分保護進出口商的合法利益,對于其所提交的合理申請,應(yīng)當(dāng)在規(guī)定時間內(nèi),盡快妥善地解決,此外,對于進出口商提供的涉及秘密的信息,管理委員會也要給予充分的保護。對那些從事南非國際貿(mào)易進出口的企業(yè)來說,南非《國際貿(mào)易管理法》為他們提供了一項明確、可靠的法律支持,為進出口貿(mào)易的順利進行和良性發(fā)展鋪平了道路。 本文從五個方面全面介紹和分析南非國際貿(mào)易管理委員會。首先從南非國際貿(mào)易管理委員會產(chǎn)生和發(fā)展的過程開始,論證南非對外貿(mào)易市場對南非國際貿(mào)易管理委員會的現(xiàn)實需要,然后論述南非國際貿(mào)易管理委員會的基本概況,接著詳細(xì)介紹該機構(gòu)的基本職能和工作程序規(guī)則,最后通過對我國對外貿(mào)易相關(guān)法律與南非《國際貿(mào)易管理法》的對比,來說明南非國際貿(mào)易管理制度對我國相關(guān)立法的借鑒意義。
[Abstract]:In recent years, South Africa's international trade has played an increasingly important role in the modernization of the South African economy. South Africa has formulated a special law to regulate South Africa's import and export trade market and to promote the development of international trade. The South African International Trade Management Act has been set up to deal with the situation in the process of South Africa's import and export trade. With the further development of relations between China and South Africa, trade between China and South Africa has become more and more frequent, and the study of the South African International Trade Management Commission has become increasingly important, but because of the short time of the establishment of this law enforcement agency, At present, the domestic research on this unique international trade management institution is basically blank. Therefore, the research on the legal system of international trade management in South Africa is of practical significance. The establishment of the South African International Trade Management Act and the establishment of the South African International Trade Management Commission provide a stronger institutional guarantee and institutional support for South Africa as a new trading market. The International Trade Management Commission is responsible not only for investigating anti-dumping, countervailing and safeguard measures and related reexamination of imported products occurring within the Customs Union, but also for investigating import and export matters related to South Africa outside the Customs Union. And the right to require local importers and exporters to provide information on their commercial activities, and the importer or exporter under investigation shall be obliged to provide the required information to the governing Council in good faith, and may be punished to varying degrees if the relevant provisions of the Act are violated. On the contrary, the International Trade Management Commission shall also fully protect the legitimate interests of importers and exporters, and shall properly resolve the reasonable applications submitted by them as soon as possible within the prescribed time frame, in addition, The Board of Governors shall also provide adequate protection for confidential information provided by importers and exporters. For those enterprises engaged in the import and export of international trade in South Africa, the South African International Trade Management Act provides them with a clear and reliable legal support, which paves the way for the smooth and healthy development of the import and export trade. This paper introduces and analyzes the South African International Trade Management Commission from five aspects. Starting from the process of the emergence and development of the South African International Trade Management Commission, the paper demonstrates the practical needs of the South African foreign trade market for the South African International Trade Management Commission, and then discusses the basic situation of the South African International Trade Management Commission. Then it introduces in detail the basic functions and working procedure rules of the organization, and finally compares the relevant laws of China's foreign trade with that of South Africa's "International Trade Management Act". To illustrate the South African international trade management system for China's relevant legislation reference significance.
