【摘要】： 明清法律中的“威逼人致死”條(以下簡(jiǎn)稱(chēng)“威逼”條)頗有別于現(xiàn)代刑法理論,已有的相關(guān)研究往往將其作為素材使用以說(shuō)明中國(guó)古代法律文化中某一方面,并大多局限于明清兩代。本文意打破明清兩代的局限,將對(duì)“威逼”條的研究向前推進(jìn)至唐代,向后續(xù)寫(xiě)《大清律例》之后的中國(guó)法律在后“威逼”條時(shí)代里的應(yīng)對(duì)。因此,本文有意將明清以前對(duì)“威逼人致死”問(wèn)題的法律應(yīng)對(duì),與明清律例中“威逼”條的確立、變遷及《大清律例》之后的法律應(yīng)對(duì)貫通起來(lái)進(jìn)行考察,以觀察“自殺肇因者須為其在自殺因果鏈中占有重要一環(huán)而付出相當(dāng)代價(jià)”的觀念如何進(jìn)入法律,并在清末及之后受到西方法律理論影響的中國(guó)近代法律中以另一種面貌繼續(xù)存在(亦即中國(guó)現(xiàn)行法律中的傳統(tǒng)因素)。本文的考察過(guò)程將側(cè)重于法律應(yīng)對(duì)(立法例)的變遷。
[Abstract]:The "threatening death" clause in Ming and Qing laws (hereinafter referred to as "coercion") is quite different from the theory of modern criminal law. Relevant studies have often used it as material to illustrate one aspect of ancient Chinese legal culture. And mostly confined to the Ming and Qing dynasties. This paper aims to break the limitations of the Ming and Qing dynasties, to push forward the study of "coercion" into the Tang Dynasty, and to deal with the Chinese law in the post-" coercive "era after the later writing of the" Qing laws and regulations ". Therefore, this paper intends to examine the legal response to the problem of "threatening death" before the Ming and Qing dynasties, and the establishment, changes and laws after the "coercion" in the laws and regulations of the Ming and Qing dynasties. To see how the idea that the cause of suicide has to pay a considerable price in the chain of cause and effect of suicide is entered into law, And in the late Qing Dynasty and after the influence of western legal theory in modern Chinese law with another appearance (that is, the traditional factors in the current law of China). The investigation process of this paper will focus on the change of legal response (legislative example).
